What is a birth injury?

What is the time limit for filing a claim?

As with any personal injury case, parties have only a certain amount of time in which to file a claim. In Georgia, the general rule is that parents must file a birth injury claim within two years of the child’s birth. However, some injuries are not noticed until the child is older. Therefore, the statute may be extended up until your child’s fifth birthday.
