Employees Injured While Traveling
At the law firm of Hilley & Frieder, P.C., in Atlanta, we frequently receive inquiries from employees who are injured while traveling for work purposes outside Georgia. While every case is unique, we can make some general comments regarding some of the most common questions we are asked:
Am I Entitled to Benefits?
Yes. As long as your injury occurred during the performance of your job duties or during non-commuting travel time, you have a Georgia claim. You can claim workers’ compensation benefits, including medical care, and disability benefits to offset wage loss.
Do I File My Claim in Georgia or Where I Was Injured?
You should file your claim in Georgia, just as you would if you were injured in Georgia. You need to notify your employer of your injury within 30 days of the accident.
Will There Be a Delay in Getting My Benefits?
Your claim should be processed the same as if your injury occurred in Georgia. However, your benefits could be delayed if the workers’ compensation insurance company disputes your claim.
If you are a Georgia resident who has suffered an on-the-job injury outside Georgia, you should speak with a workers’ compensation attorney. In a free consultation, one of our experienced attorneys can review your case, answer your questions and discuss how we can help you get the benefits you deserve.
If your on-the-job injury was caused by someone not employed by your company, such as another driver, you have a third-party claim. This can entitle you to compensation beyond the workers’ compensation benefits you receive, such as lost income and pain and suffering.
The attorneys at Hilley & Frieder, P.C., have experience in workers’ compensation cases involving car accidents and other third-party claims. We understand how to handle both claims to the advantage of our clients. We will work diligently to maximize the total compensation you receive from all sources.
