Was your child injured during birth?

On Behalf of | Apr 6, 2018 | Firm News

Parents constantly strive to protect their children. Unfortunately, sometimes the acts of others can put children, and mothers, in grave danger.

If your child was injured during birth, your entire family may have to deal with the consequences throughout the course of your child’s life. A birth injury claim can help you pay for the continuing medical care and psychological treatment your child (and other family members) may need. If you are considering filing a birth injury claim, there are a few important facts you should know.

What is a birth injury?

As the name indicates, a birth injury is an injury sustained during the birth of a child. Though people tend to think only about the children in such cases, mothers often sustain birth injuries as well. Some of the most common types of birth injuries include:

  • Cerebral palsy
  • Forceps marks or bruising
  • Vaginal tears

These and other injuries may have lasting effects on babies and mothers. However, even physical evidence of injury may not be enough. Claimants must be able to prove that a mistake occurred. This is referred to as medical malpractice.

What is the time limit for filing a claim?

As with any personal injury case, parties have only a certain amount of time in which to file a claim. In Georgia, the general rule is that parents must file a birth injury claim within two years of the child’s birth. However, some injuries are not noticed until the child is older. Therefore, the statute may be extended up until your child’s fifth birthday.

While no amount of money can erase the mistake that was made by a doctor, nurse or medical facility, a financial recovery may help to stop the same thing from happening to someone else. You don’t have to face this most difficult time alone.
