Your Rights As An Injured Worker

In Georgia, an injured worker with an accepted workers’ compensation claim is entitled to medical care for the purposes of recovery and pain relief. Some important facts about medical benefits include the following:

Your medical bills will be paid directly by the workers’ compensation insurance company — You will not have to pay any deductibles or co-pays. Your medical benefits include the cost of all treatment, mileage to and from your doctor’s office and prescription costs.

You cannot be billed for medical care, all billings must be made directly to the insurance company — Once your injury has been accepted as a workers’ compensation claim, the doctors and other medical providers that are treating you cannot send you bills for your treatment. The bills can only be sent to the insurance company.

Your medical care must be authorized by the insurance company — If your employer has a legally valid list of doctors, you must be treated by a doctor from that list. However, if your employer has failed to maintain a valid list of doctors, then you can treat with a doctor of your choice.

You can change your doctor — If you are not satisfied with your doctor, you can change to another doctor on the panel of physicians or request a change to another doctor through the Georgia Workers’ Compensation Board. You have the right to a second medical evaluation — Provided that you are drawing or have drawn disability income benefits, you may have an evaluation by a doctor of your choice at the insurance company’s expense. This doctor does not have to be from the panel of physicians. An independent medical exam can provide the information required to show the need for the continuation of your benefits or to overcome a denied claim.
